Welcome to Mind Over Mutter ("we", "our", "us"). By accessing our website, booking a coaching session, purchasing a digital product, enrolling in a program, or otherwise engaging with our services, you agree to these Terms and Conditions.

If you do not agree with these Terms, please do not use our services.

1. Business Information

Mind Over Mutter is an Australian coaching business based in Victoria providing trauma-informed life coaching, nervous system education, somatic practices, digital products, workshops, memberships and educational resources.

These Terms are governed by the laws of Victoria, Australia.

2. Coaching Services

Mind Over Mutter provides trauma-informed life coaching designed to support personal development, emotional regulation, mindset, nervous system education and behavioural change.

Our coaching services are educational and supportive in nature.

They are not psychological treatment, counselling, psychotherapy, psychiatric care or medical treatment.

No diagnosis, treatment or management of mental illness is provided through coaching services.

3. Not Medical or Mental Health Treatment

Although the founder is a Registered Mental Health Nurse, all coaching services are provided strictly as coaching.

Coaching should never replace:

• medical treatment

• psychiatric care

• psychological therapy

• counselling

• crisis intervention

• emergency mental health services

If you are experiencing a mental health crisis or are at risk of harm to yourself or others, you must immediately contact emergency services or your treating healthcare professional.

4. Client Responsibility

You acknowledge that:

• you are responsible for your own decisions

• you participate voluntarily

• you remain responsible for your emotional wellbeing

• implementation of any coaching strategies is your own responsibility

• coaching outcomes differ for every individual

Mind Over Mutter cannot guarantee specific results.

5. Eligibility

You must be at least 18 years old.

By booking, you confirm you:

• have capacity to enter a legal agreement

• provide accurate information

• will communicate honestly throughout coaching.

6. Booking and Payment

Payment is required prior to your appointment unless otherwise agreed.

Prices are listed in Australian Dollars (AUD).

Accepted payment methods are displayed during checkout.

Appointments are not confirmed until payment has been received.

7. Cancellation Policy

Individual Sessions

More than 48 hours' notice:
Session may be rescheduled.

Less than 24 hours' notice:
Session fee will be forfeited.

Failure to attend:
No refund will be provided.

Exceptional circumstances may be considered at our discretion.

8. Programs and Packages

Packages, memberships and coaching programs are non-transferable.

Unused sessions are not refundable unless required under Australian Consumer Law.

Expiry periods for coaching packages will be specified at purchase.

9. Refund Policy

Due to the nature of coaching services, refunds are generally not available once services have commenced.

Digital products are non-refundable unless required under Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantees under the Australian Consumer Law.

10. Digital Products

Digital resources, workbooks, reports, journals and downloadable materials are licensed for personal use only.

You may not:

• resell

• reproduce

• share

• distribute

• upload

• modify for resale

• teach using our materials without written permission.

11. Intellectual Property

All content remains the intellectual property of Mind Over Mutter.

This includes:

• coaching frameworks

• the YOU-niverse Blueprint

• worksheets

• journals

• PDFs

• graphics

• branding

• website content

• videos

• training material

• logos

• social media content.

Unauthorised reproduction is prohibited.

12. Confidentiality

Your personal information will be treated confidentially.

Information may only be disclosed where required by law, including where there is concern regarding serious risk of harm or where disclosure is legally required.

13. Privacy

Personal information is collected to provide coaching services and manage bookings.

Information is handled in accordance with our Privacy Policy and applicable Australian privacy legislation.

14. Communication

You agree to receive communications relating to:

• bookings

• coaching information

• appointment reminders

• purchased services.

Marketing communications require your consent and you may unsubscribe at any time.

15. Results Disclaimer

Mind Over Mutter makes no guarantees regarding:

• emotional outcomes

• financial outcomes

• relationship outcomes

• business outcomes

• career outcomes

• health outcomes.

Testimonials represent individual experiences only and are not guarantees of future results.

16. Limitation of Liability

To the maximum extent permitted by law, Mind Over Mutter will not be liable for indirect, consequential or incidental loss arising from participation in coaching services.

Where liability cannot legally be excluded, it is limited to the remedies available under the Australian Consumer Law.

Nothing in these Terms excludes any rights that cannot lawfully be excluded.

17. Website Use

You agree not to:

• misuse the website

• attempt unauthorised access

• introduce malicious software

• interfere with website functionality.

18. Third-Party Links

Our website may contain links to third-party websites.

We are not responsible for their content, privacy practices or services.

19. Testimonials

By submitting a testimonial, you grant Mind Over Mutter permission to publish it unless you specifically request otherwise.

Personal identifying information will not be used without consent.

20. Online Sessions

Clients are responsible for:

• a stable internet connection

• a private environment

• appropriate technology.

If technical issues occur, sessions may be rescheduled where appropriate.

21. Code of Conduct

Mind Over Mutter reserves the right to suspend or terminate services where a client:

• behaves abusively

• is threatening

• engages in harassment

• attends sessions under the influence of drugs or alcohol

• repeatedly breaches these Terms.

22. Changes to Services

We reserve the right to modify coaching services, pricing or programs.

Changes will not affect services already purchased unless agreed.

23. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law.

Consumer guarantees continue to apply where required by law.

24. Governing Law

These Terms are governed by the laws of Victoria, Australia.

Any dispute will be subject to the jurisdiction of the courts of Victoria.
